Presents the argument that U.S. precedent is clear in the matter, Elian is a Cuban refugee and Cuban refugees have been openly accepted by the U.S. government. Concludes that they boy's father, who remains in Cuba and has expressed his wishes that Elian be returned, gave up his right to determine the fate of Elian when he allowed him to leave Cuban soil.
